“Affirmative Action and the Constitution,” the edited transcript of an AEI public policy forum, examines the controversy generated by attempts to achieve equality under the Constitution and laws of the United States through affirmative action. Few questions so divide our nation today as the use of race-, sex-, or ethnic-conscious measures, especially when numerical goals are used to increase minority group opportunities in employment or admissions to colleges and professional schools. One side contends that such policies are necessary to ensure an equality of results, reflecting a true equality of opportunity. The other side argues that such preferences are unconstitutional reverse discrimination.
Can we achieve equality in America without race-, sex-, and ethnic-conscious remedies for discrimination? Is it just and constitutional to deny a qualified person an equal chance for a job by giving someone else a preference, to redress past injustices or to eliminate present discrimination? Do groups have rights under the Constitution, or does the Constitution require that individual rights predominate in every instance? These and other questions are addressed by a distinguished panel. |
